Expenditure by members of the European Parliament of their allowances: information of public access or personal data?

The article analyzes the decision of September 25th, 2018 of the General Court, which rejects the appeals lodged against the European Parliament (“EP”) Decision that denied access to information regarding the way in which the diets of its members are used.
The ruling confirms the decision of the EP, rejecting the resources, citing three central arguments. The first, related to the declaration of non-existence of information, in relation to the detail of the bank accounts of the Members of the European Parliament (“MEPs”). The second, argues that, as long as the documents contain personal data such as the names of the MEPs, the appropriate procedure according to the exception of art. 4.1.b) of Regulation No. 1049/2001, is that established for the processing of personal data of Regulation (EC) No. 45/2001. The third confirms the rejection of partial access to information based on an excessive administrative burden.
