Ten years since the approval of the Law 19/2013
An overview of active publicity patterns in Spanish local councils

A decade after the implementation of the Law 19/2013, we still lack a comparative review of the level of compliance that includes a broad selection of Spanish municipalities. Despite the existence of studies assessing active transparency compliance and the existence of several indices, most of the contributions are focused exclusively on the largest municipalities. In order to fill this gap, we have monitored the active transparency disclosure patterns of Spanish local councils over 10.000 inhabitants and a selection of 300 under 10.000 inhabitants. To assess compliance, we have built an index with the Law’s main elements. The results show a dissimilar and insufficient implementation of active transparency legal obligations and, for better regulatory compliance, an external compliance monitoring system that promotes and encourages practices and experiences should be promoted. Likewise, moving away from the homogenization imposed by the norm should also be considered, establishing specific articulations of regulatory obligations depending on the nature, dimension, and institutional capacity.
