Transparency in Public Procurement (Mexico): Regulatory Assessment and Recommendations

This research examines the foundation, motivation, legality, and transparency of public procurement, based on Articles 6, 16, and 134 of the Mexican Constitution. It identifies the stages of the bidding process, highlighting the critical moment of proposal evaluation, which, despite its relevance, lacks clear and mandatory guidelines for its documentation and publication, leading to opacity and regulatory contradictions. The analysis addresses federal laws governing the bidding process, revealing that, although they stipulate public acts such as the call for proposals, opening of proposals, and awarding, they fail to define and make transparent the technical opinion that underlies the final decisions. Recommendations include reforming regulations to make it mandatory to register and publish the evaluation opinion, as well as incorporating audiovisual media to document complex processes, strengthening transparency. It emphasizes that publicity and access to information are fundamental pillars for guaranteeing the right to legal certainty, combating corruption, and fostering a culture of legality in the management of public resources.
