The Whistleblower Protection Authorities and Their Compliance with Transparency Regulations

This paper analyzes the legal nature of whistleblower protection authorities. The issue is particularly relevant given the doubts that may arise from the fact that most regional authorities are attached to their respective parliaments rather than to their general administrations. It concludes that, despite this, they are independent administrative authorities subject to their own regulations and, in matters not covered by these, to the rules of administrative law. This implies their full compliance with regulations on transparency and access to information and control by independent transparency authorities. However, the nature of the activity of whistleblower protection authorities justifies that, in many cases, access to the information generated in the exercise of their functions is prevented or limited by the concurrence of limits provided for in transparency regulations.
