Active Transparency: Control and Sanction, Those Great Forgotten Ones

While the effectiveness of the right of access to public information is guaranteed through the right of the interested party to lodge a complaint before the Council for Transparency and Good Governance and other independent bodies, compliance with proactive disclosure obligations requires oversight action—both ex officio and on the basis of complaints—also entrusted to independent bodies equipped with the necessary coercive powers to enforce the law. Furthermore, insofar as non-compliance with proactive disclosure obligations generally has no impact on the validity of administrative actions, the only legal response to such unlawful conduct is the sanctioning regime. This paper examines the shortcomings of oversight activity and of the sanctioning regime in the field of proactive disclosure, both at the state and regional levels.
